I got a letter from a substitute trustee and I do not understand it.

Accepted Answer

Usually the first formal step, not the last. It means a hearing has been set or is coming. It is not an eviction and it is not a sale date. Read it for two things: the hearing date and the name of the trustee. Everything else can wait a day. We can pull the file and tell you what has actually been filed against the property, at no cost.

Question 2

There is a hearing date. Do I have to go?

Accepted Answer

You are entitled to be there and it is usually worth going. The Clerk of Superior Court is deciding a narrow set of questions, not whether you deserve to keep the house, and the hearing does not end anything the same day. If you are going to contest anything about the debt or the notice, that is an attorney's job and you want one before the date, not after.

Question 3

I am behind but there is no filing yet.

Accepted Answer

This is the best position on this page and almost nobody who is in it knows that. Every option is still open, including the ones that close the moment a filing hits. Call your servicer's loss mitigation department and ask for a hardship package and a written reinstatement quote. If you want, we will tell you which of the paths actually fits your numbers.

Question 4

I applied for a modification. Is the sale still happening?

Accepted Answer

Possibly. Foreclosure activity may or may not pause while a servicer reviews a file, and assuming it paused is one of the most expensive mistakes in this process. Get the answer from your servicer in writing. Not on a call, in writing. Then work both tracks until one of them closes.

Question 5

The auction already happened.

Accepted Answer

You may still have time, and most people in this position do not know it. North Carolina has an upset bid period. Under N.C.G.S. § 45-21.27 it runs ten days, but it runs from the day the report of sale is filed with the Clerk, and the trustee has five days after the sale to file it. Your actual deadline can land as much as fifteen days after the auction. Do not count from the auction date. Call the Clerk of Superior Court and get the filing date. Until that window closes with no new bid, the sale is not final. Days matter here in a way they did not at any earlier point, so call an attorney today, and call us today if selling inside that window is on the table.

Question 6

I owe more than it is worth.

That is a short sale, and it is the one most agents have never done. The lender has to approve the price, they order their own valuation, and every lien behind the first gets negotiated separately. Question 7

I filed bankruptcy.

Accepted Answer

Then your attorney is driving and we are not. An automatic stay changes what can happen and when, and nothing about your property should be decided without your bankruptcy attorney in the conversation. Tell us who they are and we will work through them or stay out of it entirely.

Question 8

My mother died and the house is still in her name.

Accepted Answer

Extremely common and completely fixable. Whether the property can be sold depends on what has been opened with the Clerk of Superior Court and what the deed actually says, and those are two different documents that often disagree. We will pull both, at our cost, and tell you where things actually stand. You owe us nothing for that whether you sell or not.

Question 9

Probate was never opened and it has been years.

Accepted Answer

Still fixable, and the passage of time is usually less of a problem than people fear. There are established ways to handle an estate that was never administered. What it takes depends on the will, the heirs, and how the deed reads. This one needs an attorney and we will help you get to one.

Question 10

I am the executor. Can I sell it?

Accepted Answer

Sometimes yes, sometimes only with the Clerk's involvement, and it turns on the will, the letters that were issued, and what else the estate owes. Being named executor is not the same as having authority to convey. An attorney or the Clerk confirms it, and we will tell you which documents to bring so that conversation takes ten minutes instead of three visits.

Question 11

There are five heirs and two of them will not speak to me.

The most common reason estate properties sit for years. We work with every heir at once, put the same offer in front of everybody, and we do not take sides or carry messages. Nobody gets a different number than anyone else. If the disagreement is legal rather than personal, that is an attorney's problem and we will say so.

Question 12

The house is full of forty years of their belongings.

Accepted Answer

Not a problem, and not something you need to solve before calling. We buy as-is with everything still in it. Take what matters to you and leave the rest. This is the single most common reason people put off making the call, and it should not be.

Nobody has paid the mortgage since the funeral.

Then there are two clocks running at once, the estate and the loan, and the loan does not wait for the estate. This is where the foreclosure side and the probate side of our work overlap, and it is most of what we do. There is usually more room than it looks like, but there is less of it every month.

I live in another state.

Accepted Answer

Most heirs do. We do the county record work here, walk the property, and send you what we find. North Carolina closings run through attorney offices, and remote closings are routine.
