Where do foreclosure and estate files go in Mecklenburg County?
Answer: Both go to the Mecklenburg County Clerk of Superior Court. The Clerk hears power-of-sale foreclosures as special proceedings (G.S. 45-21.16) and serves as the probate judge for estates (G.S. 28A-2-4).

For estate special-proceedings documents filed before that date that aren't on Portal, nccourts.gov says to email the Estate Special Proceedings division at Mecklenburg.ESP@nccourts.org (include the party names and the file number if you know it).
- Parking: nccourts.gov points court visitors to the 4th Street Parking Deck at 4th and McDowell streets. It lists the rate as $1.00 per half hour or $12.00 for the day, and the court doesn't validate parking.
Where are deeds and substitute-trustee filings recorded in Mecklenburg County?
Answer: At the Mecklenburg County Register of Deeds. In our experience, a recorded "substitution of trustee" is often one of the first public signs that a lender is getting ready to foreclose.

How do property-tax foreclosures work in Mecklenburg County?
Answer: NC property taxes are due September 1, and interest starts January 6 (G.S. 105-360). After that, counties can foreclose on the tax lien, either by civil action (G.S. 105-374) or in rem (G.S. 105-375). Here's what Mecklenburg County's own pages say:
- Mecklenburg's Office of the Tax Collector says tax foreclosures are filed either mortgage-style under G.S. 105-374 or in rem under G.S. 105-375, and the tax office decides which. In-rem cases are handled in-house by an Assistant County Attorney assigned to the Tax Collector.
- Notices of sale are published in the Mecklenburg Times once a week for two weeks and posted at the courthouse for at least 20 days. Sales are held at the courthouse at 832 East 4th Street.
- Upset bids go to the Special Proceedings Division of the Clerk of Court: at least 5% of the last bid or $750, whichever is greater, within the 10-day period.
What do sellers in Mecklenburg County usually run into?
- Inherited a house in an older Charlotte neighborhood, with heirs in other states. One sibling lives nearby, the others are out of state, and the deed is still in a parent's name. With a Mecklenburg estate, check eCourts Portal first. For older files, the ESP email address above is the way to get copies without driving uptown.
- Behind on the mortgage in Huntersville, Cornelius or Davidson. North-county homeowners still go to the courthouse in uptown Charlotte for the foreclosure hearing. That's about a 25-mile drive from Davidson. Put the hearing date on your calendar the day the notice arrives.
- Back taxes on a house in Charlotte. Because Mecklenburg may use the in-rem process (G.S. 105-375), the tax lien can move toward a sale without the kind of hearing a mortgage foreclosure gets. Call the Tax Collector early to ask about the account.
