How do property-tax foreclosures work in Lincoln County?
Answer: NC property taxes are due September 1, and interest starts January 6 (G.S. 105-360). After that, counties can foreclose on the tax lien, either by civil action (G.S. 105-374) or in rem (G.S. 105-375). Here's what Lincoln County's own pages say:
- Lincoln County says its tax foreclosures are handled by The Kania Law Firm under G.S. 105-374 (the mortgage-style method).
- Sales are held on the front steps of the courthouse at 120 Justice Drive. The high bidder pays a 5% deposit by cash or certified funds the day of the sale. The sale stays open 10 days for upset bids of at least 5% or $750.
- Once the upset period ends, the buyer pays the balance plus the recording fees and revenue stamps charged by the Register of Deeds.
What do sellers in Lincoln County usually run into?
- A Denver or Westport-area house on the Lincoln side of Lake Norman. East Lincoln feels like part of the Lake Norman suburbs, but the courthouse and deeds are in Lincolnton, about 20 miles west. Plan for that drive, or use eCourts Portal and the online deeds search.
- Searching recent Lincoln deed records. The official search link from the Register of Deeds is us5.courthousecomputersystems.com/LincolnNC2/. It has a picture check when it loads. In our experience, new recordings show up online about a week after they're recorded.
- Past-due taxes on inherited land in Vale or Iron Station. Lincoln uses the mortgage-style tax foreclosure (G.S. 105-374), which is a court action with a summons to the owners of record. Heirs can be named. Call the tax office before it gets that far.
