    Where do foreclosure and estate files go in Cabarrus County?

    Answer: Both go to the Cabarrus County Clerk of Superior Court. The Clerk hears power-of-sale foreclosures as special proceedings (G.S. 45-21.16) and serves as the probate judge for estates (G.S. 28A-2-4).

    Where are deeds and substitute-trustee filings recorded in Cabarrus County?

    Answer: At the Cabarrus County Register of Deeds. In our experience, a recorded "substitution of trustee" is often one of the first public signs that a lender is getting ready to foreclose.

    How do property-tax foreclosures work in Cabarrus County?

    Answer: NC property taxes are due September 1, and interest starts January 6 (G.S. 105-360). After that, counties can foreclose on the tax lien, either by civil action (G.S. 105-374) or in rem (G.S. 105-375). Here's what Cabarrus County's own pages say:

    • Cabarrus Tax Collections (also at 65 Church Street S) says bills go out toward the end of July, are due September 1, and become delinquent if not paid by the following January 5. After that, a bill "is subject to collection actions and/or tax foreclosure." (State law: G.S. 105-360.)
    • Tax Collections offers payment plans, but the bill still has to be paid in full by the delinquent date. The county says to ask as early in the year as possible.
    • Active tax-foreclosure cases, sale dates and minimum bids are posted at foreclosures.cabarruscounty.us.

    What do sellers in Cabarrus County usually run into?

    • Inherited a house in Kannapolis, and the city crosses the county line. Kannapolis sits in both Cabarrus and Rowan counties. The estate is opened where the person lived, but the deed and any foreclosure follow the county where the house is. Check the parcel's county before you go to the wrong courthouse.
    • Behind on payments in a newer Harrisburg or Concord subdivision. An HOA can foreclose on unpaid assessments much like a lender (G.S. 47F-3-116; condo associations, G.S. 47C-3-116). If you're getting HOA letters as well as mortgage letters, deal with both.
    • Past-due taxes on a family property in Mount Pleasant or Midland. Call Tax Collections before January 5 if you can. After that, the account moves into collection and possible foreclosure.
